Version 1.0 of 4 October 2026. This document was prepared on the basis of the legislation checked on that day; it will be reviewed by a lawyer before the Application is made available beyond family and friends. Legal basis: Art. 8 of the Act on Providing Services by Electronic Means, Regulation (EU) 2022/2065 (DSA), the Consumer Rights Act.
This is a translation for convenience. The Polish version is binding.
§ 1. Service Provider
- The service is provided by Andrzej Brzeziński, running a business under the name NEW PROJECT Andrzej Brzeziński, ul. Mickiewicza 4/8, 19-300 Ełk, Poland, NIP (tax ID) 8481164296, REGON 368419998 (the "Service Provider").
- Contact: office@newproject360.pl, postal address as above. This address is also the point of contact for users and authorities within the meaning of Art. 11 and 12 DSA; correspondence in Polish or English.
§ 2. Definitions
- Application: the service available at https://czerwona-teczka.newproject360.pl/.
- Owner: an adult natural person who keeps a Folder for their own affairs. A couple's Folder has two Owners (person A and person B).
- Folder: the collection of the Owner's information, documents, contacts, letters and instructions.
- Safe: the part of the Folder encrypted in the browser; the Service Provider does not know the key.
- Trusted Person: a person designated by the Owner who, after accepting the invitation, has an account and may submit a request for Emergency Access.
- Emergency Access: making part of the Folder available to a Trusted Person after a request (incapacity or death) and after the delay set by the Owner has passed, unless the Owner refuses.
- Check-in Switch: a periodic request asking the Owner to confirm that everything is fine; if no confirmation is given, the Trusted Persons are notified.
- Folder Helper: a person authorised by the Owner to fill in the Folder (e.g. a child helping a senior). The Folder Helper has no access to the Safe or the letters.
- Gift Folder: a Folder prepared by one person and handed over to another; on acceptance, the recipient becomes the Owner.
§ 3. Services
- The Service Provider provides, free of charge, a service of keeping an account and a Folder, which includes: storing documents with text recognition of scans on the Service Provider's server, a checklist of matters in case of incapacity and death, the Safe, Trusted Persons and Emergency Access, the Check-in Switch, a register of letters with institutions and letter templates, printing and downloading documents (PDF, Word, Excel, ZIP), data export and e-mail reminders.
- The Application is made available by invitation from the Service Provider or an Owner (family and friends).
- The Application organises information. It is not legal, tax or medical advice and does not replace a will, a power of attorney, instructions given to banks and institutions, or original documents. A will requires the form set out in Art. 949-953 of the Civil Code; a file in the Application is not a will. A power of attorney is effective only in the form required by law and, as a rule, expires on the death of the principal.
- Legal descriptions in the Application state the legal position and the date of verification. The Service Provider checks changes in the law every month and publishes them on the "Changes in the law" page, but does not guarantee that the descriptions are complete or up to date on every day.
§ 4. Technical requirements and risks
- A device with internet access and an up-to-date browser supporting the Web Crypto API; essential cookies enabled; an e-mail account. The Owner additionally logs in with a code from an authenticator app on their phone or, if so configured, with an e-mail code.
- Specific risks (Art. 6 of the Act on Providing Services by Electronic Means): password phishing, malware on the device, loss of the Safe password and the recovery code. The Service Provider cannot recover the contents of the Safe without the Safe password, the recovery code or the code from a Trusted Person's envelope.
§ 5. Conclusion and termination of the agreement
- The agreement is concluded at the first login after the invitation and acceptance of the Terms of Service. Only an adult with full legal capacity may have an account.
- The agreement is concluded for an indefinite period. The user may terminate it at any time by requesting deletion of the account in the Application or by writing to the address in § 1. Before deletion, the user may download their data.
- The Service Provider may terminate the agreement for important reasons (gross breach of the Terms of Service, discontinuation of the service) with 30 days' notice, during which the data can be downloaded.
- Death of the Owner: the Folder remains available to the Trusted Persons within the scope of Emergency Access for 12 months from the opening of access on the grounds of death. 30 days before the end of that period they receive an e-mail reminding them to download the data; the Folder is then deleted.
- An account with no login for 24 months and no response to e-mail reminders may be deleted.
§ 6. Rules of use
- The Owner enters data of other persons (family, Trusted Persons, doctors, advisers) solely for personal and family purposes, to the extent needed by their close ones.
- The Owner enters health data of other persons only with their consent or as their statutory representative.
- It is forbidden to provide unlawful content, in particular content infringing the rights of third parties, malware and content derived from a criminal offence.
- A senior's Folder: the Owner is the senior; the Folder Helper acts under the senior's authorisation, which the senior may withdraw at any time, and every step taken by the Folder Helper is recorded in the Folder's history.
- A couple's Folder: the shared part is visible to and editable by both persons; each person has their own personal matters, Safe, letters and Trusted Persons. Each person may have the Folder split.
- Passwords in the Safe serve to put matters in order. After the Owner's death, Trusted Persons should not log in to the Owner's online banking or dispose of the Owner's funds; the heirs and persons named in a disposition on death have rights to the deceased's accounts, under the procedure set by the bank.
§ 7. Emergency Access
- The Owner designates Trusted Persons, setting for each one a separate scope for incapacity and for death, and the delay (7 days by default).
- After a request, the Owner receives an e-mail allowing them to refuse with one click, with reminders every 24 hours. If the Owner does not refuse within the delay, read-only access is opened within the set scope.
- The Service Provider does not verify whether a report of incapacity or death is true. The choice of Trusted Persons and the length of the delay is the Owner's; a Trusted Person who submits a false request may obtain access if the Owner does not refuse within the delay.
- Every view and download by a Trusted Person is recorded in a history visible to the Owner.
- The Trusted Person keeps the information from the Folder confidential and uses it only for the purpose for which the Owner made it available.
§ 8. Reporting unlawful content
- Anyone may report content they consider unlawful to the address in § 1, stating the reasons, identifying the content, and giving their details and a statement of good faith.
- The Service Provider does not review the contents of Folders and has no access to the Safe. It handles reports and orders from authorities without undue delay; it informs the user of any restricting decision, with reasons.
§ 9. Complaints
- Complaints about the operation of the Application: to the address in § 1, with a description of the problem and contact details.
- The Service Provider replies within 14 days.
- A consumer may use out-of-court dispute resolution methods (e.g. the municipal consumer ombudsman, the provincial inspector of the Trade Inspection).
§ 10. Liability and security
- The Service Provider encrypts documents on the server (AES-256-GCM) and the Safe in the browser, uses two-factor authentication and makes daily backups.
- The Service Provider is not liable for the consequences of a user losing passwords and codes, the Owner's decisions regarding Trusted Persons, the legal consequences of a missing or defective will or powers of attorney, or content entered by users, unless the damage results from wilful misconduct or the law does not permit liability towards a consumer to be limited.
- Technical interruptions are announced in advance where possible.
§ 11. Personal data
The rules for processing data are described in the Privacy Policy, available in the Application before the Terms of Service are accepted.
§ 12. Changes to the Terms of Service
- The Service Provider may change the Terms of Service for important reasons: changes in the law, changes to the Application's functions, security considerations.
- The Service Provider gives notice of a change by e-mail and in the Application at least 14 days before it takes effect; anyone who does not accept the changes may terminate the agreement and download their data.
- Previous versions of the Terms of Service are available in the Application.
§ 13. Final provisions
- The Terms of Service are available free of charge in the Application in a form that allows them to be downloaded, saved and printed.
- Governing law: Polish law; a consumer retains the protection of the law of the country of their habitual residence, where it applies.
- The Terms of Service apply from 4 October 2026.
